1. Agreement to Terms

By accessing and using Austial (“we,” “our,” or “us”), you accept and agree to be bound by the terms and provision of this agreement.

These Terms of Service (“Terms”) govern your use of our website located at austial.com (the “Service”) operated by Austial Inc.

If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Austial is a project management platform that provides tools and services for team collaboration, task management, and workflow optimization. Our Service includes:

  • Project planning and tracking tools
  • Team collaboration features
  • Task and deadline management
  • Analytics and reporting capabilities
  • Integration with third-party applications

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and all activities that occur under your account.

Important: You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

5. Acceptable Use Policy

You may not use our Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
  • To submit false or misleading information
  • To upload or transmit viruses or any other type of malicious code

6. Subscription and Billing

Some parts of the Service are offered as paid subscriptions. You will be billed in advance on a recurring basis (“Billing Cycle”). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select.

Refund Policy

You may cancel your subscription at any time. Refunds are available within 30 days of initial purchase for annual plans, and within 7 days for monthly plans.

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

  • We implement appropriate security measures to protect your data
  • You retain ownership of your data uploaded to our Service
  • We do not sell your personal information to third parties
  • Data processing is governed by applicable privacy laws including GDPR and CCPA

8. Limitation of Liability

In no event shall Austial Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our liability to you for any damages arising from or related to this agreement will not exceed the amount you have paid us in the past twelve months.

9. Service Availability

We strive to maintain high service availability but cannot guarantee 100% uptime. We may experience:

  • Scheduled maintenance windows (with advance notice)
  • Unexpected technical issues
  • Third-party service dependencies

Current service level agreements and uptime statistics are available in your account dashboard.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days advance notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
